Conditions of Sale

These General Conditions of Sale apply, without limitation or condition, to all sales of products marketed by New Nails System srl with registered, operational and administrative headquarters in Corso Principe Amedeo,175 84013 cava de' tirreni (SA) and, VAT number and tax code it05839820650 via the website www.newnailssystem.com

The sales prices indicated are expressed in euros including VAT, without taking shipping costs into account. The latter are always paid by the Customer and are invoiced at the time of validation of the order, as a supplement to the selected products. The "SELLER" reserves the right to change prices without notice and to modify shipping prices at its discretion, but undertakes to apply the prices in force and to explicitly display prices and shipping costs, as indicated on the site, at time of order. Any refunds are always made by New Nails System srl via the payment system used to make the purchase, via Paypal, credit card, bank transfer both in the case of payment by bank transfer and in the case of cash on delivery. Conditions subject to Legislative Decree 206/2005

Shipping Times

What happens to your order a moment after purchasing on www.newnailssystem.com from the "SELLER":

The delivery times of the products vary depending on the item ordered by the Customer and the delivery methods chosen by the same. The customer can choose standard shipping which takes 3 to 5 WORKING days or express 24/48 WORKING hours. However, the times indicated are merely indicative and are in no way binding for the "SELLER". For express shipping with delivery within 24/48 working hours, the indications mentioned below apply:

A) Day 0 (receipt of order)

the back office processes orders received by 12.00, otherwise they are processed the following day. The same applies to orders received on Saturday, Sunday or a public holiday: they will be processed on the first working day following that of the order itself. The order is processed according to the payment method chosen, and in particular:

- if the payment method chosen is PAYPAL or CASH ON DELIVERY, the order will be processed the same day or if the payment was made after 12.00, the order will be processed the following day.

- if the chosen payment method is BANK TRANSFER, the order will be processed when the credit is displayed on the bank account of the New Nails System srl Company

- if the payment method chosen is CREDIT CARD, the order will be processed after 24 hours.

The order is sent to our warehouses by 6.00 pm;

B) Day 1 (Courier)

the day after the order is placed, the Courier and Freight Forwarder collects the goods from our warehouses by 6.00 pm. The courier will be given the accompanying invoice containing the destination location and any notes included in the order.

C) Day 2 (delivery of goods)

The product will be delivered to the address indicated when confirming the order.

Shipping Cost:

The cost of transport is determined by the courier and depends on the weight and/or volume of the package(s) that the customer purchased.

For shipments to Italy, transport costs are free for single orders equal to and/or greater than €150.00

The invoice

The invoice must be requested when ordering, correctly indicating all your data such as company name, address, postcode, city, VAT number, unique code and pec.

The invoices will be sent electronically directly to the customer's tax drawer.

Upon request it is possible to have a copy of the "courtesy invoice".

Refunds

Customers will have New Nails Ssytems srl as a single point of contact for any complaint or for any related problem both in the order phase and in the post-sales phase, which is equipped with all the tools to manage both via Call Center and via messaging systems active on working days from Monday to Friday from 9:00 to 13:00 to analyze problems and seek a solution to the problems of the individual customer. Any refunds are made by New Nails System srl via the payment system it deems appropriate at the time. The refund will be made no later than 14 working days.

Order Fulfillment

New Nails System srl, in order to guarantee a correct service to its Customers, guarantees the receipt and acceptance of purchase orders until 5.00 pm from Monday to Friday; orders received after this time, as well as those received on a Saturday, Sunday or other public holiday, will be considered received on the first working day following that of the order itself. Any decreases in working hours and/or interruptions of sales services in particular periods of the year (e.g. summer months) which could lead to an extension of delivery times will be adequately highlighted at the time of the order, and will be at the discretion of the Customer proceed or not to confirm the same according to the times indicated. Upon delivery of the goods the Customer is required to check:

- that the number of packages delivered corresponds to what is indicated in the transport document

- that the packaging is intact and unaltered, including the closing tapes

In the event of tampering and/or breakages, the Customer must immediately contest the shipment and/or delivery by placing the words "RESERVE FOR DAMAGED PACKAGING" on the copy of the delivery document to be returned signed to the courier or other operator.

The Customer is required to report any damage within 7 days of receiving the goods, by registered mail in advance or by e-mail to the following addresses:

For each order the Customer is required to specify at least one telephone number to allow the express courier to contact him in case of delivery difficulties; if the delivery is not successful for reasons not attributable to New Nails System, or to the express courier for more than 5 consecutive days, the order will be considered canceled and the Customer will be charged for storage costs as quantified by the express courier .

Guarantees

All products sold by "SELLER". are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree 24/2002. To benefit from warranty assistance, the Customer must keep the invoice (or transport document) that he will receive via email in PDF format. The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation inside the product packaging. It is specified that the 24 month guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or who makes the purchase without indicating a VAT number reference in the order form).

For professional use All New Nails System machines are covered by the Commercial Warranty as per art. 133 of the Legislative Decree. 206/05 which provides 6 months of coverage.

If, following intervention by an Authorized Assistance Centre, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs, if supported by "SELLER".

It is specified that "SELLER" cannot be held responsible under any circumstances for the activity of the technical assistance centers on the products: any delays in repairs and/or any replacements, and/or failure to recognize the authorized technical assistance center of the malfunction, as required by Legislative Decree no. 24/2002, and/or any other hypothesis deemed prejudicial to the Customer, are to be attributed exclusively to the policies of the Manufacturers.

In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, intact consumables, manuals, cables , etc...); to limit damage to the original packaging, we recommend, when possible, placing it in a second box; In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided.

All shipments of products will be rejected to the Sender, at his expense:

- Not including original packaging, accessories and manuals

- Received with unsuitable or inadequate external packaging and therefore damaged during transport: the Warranty does not cover damage due to non-use of the original packaging and adequate external protective safety packaging not authorized by the assistance centre.

- Tampering with the product and/or machinery in one or more parts.

Conventionally, any right of the Customer to compensation for damages or compensation is excluded as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things.

Transport Insurance

Upon receipt of the package, it is necessary to check that the courier's packaging is intact and not cut and/or tampered with. Otherwise, it is likely that the package was opened during shipping and the contents were stolen.

If you accept a tampered package, there is no possibility of making a complaint.

So we repeat: before accepting the package, it is necessary to check its integrity.

In case of suspected tampering or a missing package, it is possible to accept the goods with specific reservation (indicate the reason). The customer is required to report any damage within 7 days of receiving the goods. We inform you that pursuant to Legislative Decree 22/5/1999 n. 185, the goods travel at the risk of the recipient, New Nails System srl, and "SELLER" is not responsible for any theft or damage.

For completeness of information, we report an extract from the legislative decree that regulates this topic:

EXTRACT OF LEGISLATIVE DECREE 22/5/1999 n. 185 ON CONTRACTS CONCLUDED AT DISTANCE "Commercial sales relationships are governed by these conditions of sale as per current Italian legislation. The Supplier carries out shipments to the Customer with selected express couriers and the goods travel free of charge with transport costs and risks to entirely borne by the Customer himself. These expenses and other charges possibly connected to the transport and/or shipping of the products are counted and detailed in the order confirmation and in the purchase invoice. Upon receipt of the goods at his home, the Customer must verify the integrity of the packages. In case of discrepancies and/or discrepancies, it will be the Customer's responsibility to refuse the package under penalty of forfeiture of asserting their rights in this regard".

Right of withdrawal

"SELLER" recognizes the right of withdrawal:

Pursuant to Legislative Decree 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase indicating in the order form to New Nails System srl a VAT number reference), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. Goods returned without authorization will be automatically rejected.

In addition to the desire to exercise the right of withdrawal, it is essential to indicate in the same communication the details of a bank or postal account to re-credit the amount due (CIN Code, ABI Code, CAB Code, Current Account Number, Account Holder) . For the correct recognition of the right of withdrawal, we specify that:

New Nails Systems srl reserves the right to control the returned goods to assess any damage or tampering not resulting from transport.

In case of exercising the right of withdrawal, the Customer will be fully refunded the amounts paid for the purchase of the product including the delivery costs incurred, and will be carried out no later than 14 days from receipt of the order withdrawal communication, exclusively by bank transfer . In the event that the user opts for the replacement of the product, the costs of sending the new product will be borne by him.

Applicable law

The sales contract between the Customer and "SELLER" is intended to be concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, the territorial jurisdiction is exclusively that of the Court of Salerno.

Sales contract

The customer can only purchase the products, as per the electronic catalog on the website www.newnailssystem.com, existing at the time the order is sent.
